1. Purpose and Scope
This document sets out the identity verification requirements that apply to guests, account holders, and any person conducting transactions at Stoney Nakoda Resort & Casino. These requirements exist to meet obligations under Canadian federal law, including the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA) and guidance issued by the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC).
Identity verification is a legal condition of participation in certain activities and transactions at the property. This policy applies to all individuals regardless of residency, citizenship, or the nature of their visit.
2. Legal Basis
Stoney Nakoda Resort & Casino operates within the Canadian regulatory framework governing casino and gaming establishments. Under FINTRAC guidance, casinos are required to verify the identity of persons and entities in connection with specific transaction types and thresholds. Failure to comply with a verification request may result in refusal or suspension of a transaction or account access.
The primary triggers for mandatory identity verification include, but are not limited to, the following:
Transaction type
Threshold
Large cash transaction
- 10,000 CAD or more received in a single transaction
Large virtual currency transaction - 10,000 CAD or more
Casino disbursement - Any applicable disbursement as defined by FINTRAC
Extension of credit - 3,000 CAD or more
Receipt of funds - 3,000 CAD or more
Foreign currency exchange - 3,000 CAD or more
Suspicious transaction - Any amount, at any time
These thresholds reflect current FINTRAC requirements. Stoney Nakoda Resort & Casino may request identity verification outside these thresholds where there is reasonable cause to do so.
3. What Is Verified
When identity verification is required, the following is confirmed:
3.1 Identity of the Individual
Verification confirms that the person presenting themselves is who they claim to be. This includes confirming full legal name, date of birth, and, where applicable, residential address.
3.2 Age
All persons must be of legal gambling age in the applicable jurisdiction. Identity documents are used to confirm age at the point of entry or account creation. No exceptions are made to this requirement.
3.3 Source of Funds or Transaction Ownership
In certain circumstances, particularly for large transactions or disbursements, confirmation may be requested that the funds involved belong to the person presenting them. This may include documentation relating to payment method ownership.
4. Accepted Identity Documents
Accepted documents are government-issued and include a photograph and sufficient information to confirm the individual’s identity. Acceptable documents include, but are not limited to:
- Valid Canadian passport
- Provincial or territorial driver’s licence
- Canadian permanent resident card
- Federal or provincial government-issued photo identification card
- Foreign passport (where applicable)
Documents must be current and unaltered. Expired documents are not accepted. Photocopies or digital images of documents are not accepted in place of original documents unless specifically requested through an account-based verification process.
5. Verification Methods
Depending on the nature of the transaction or account activity, verification may be conducted through one or more of the following methods:
5.1 In-Person Document Check
A staff member reviews the original government-issued document and confirms that the information matches the individual present.
5.2 Document Upload
For account-related verification, individuals may be asked to submit a clear digital copy of an accepted identity document through a designated secure channel. Submissions must be legible and complete.
5.3 Proof of Address
Where address confirmation is required, acceptable documents include recent utility bills, bank statements, or government correspondence dated within the past 90 days. The document must display the individual’s full name and residential address.
5.4 Facial or Biometric Confirmation
In applicable account-based processes, a selfie or liveness check may be required to match the individual against the submitted identity document. This step is used to prevent identity fraud and confirm document ownership.
6. Obligations of the Individual
Any person subject to identity verification at Stoney Nakoda Resort & Casino is required to:
- Provide accurate and complete information when requested
- Present valid, unaltered documents
- Cooperate with staff or system-based verification steps
- Notify the company promptly if any submitted information changes
Providing false, misleading, or fraudulent documentation may result in immediate refusal of service, account closure, and referral to the relevant authorities.
7. Obligations of the Company
Stoney Nakoda Resort & Casino is required to:
- Conduct identity verification in accordance with FINTRAC guidance and applicable Canadian law
- Retain records of identity verification for the period required by law
- Protect personal information collected during verification in accordance with applicable Canadian privacy legislation
- Refrain from using identity information for purposes beyond those required by law and internal compliance obligations
8. Data Retention and Privacy
Personal information collected during identity verification is handled in accordance with applicable Canadian privacy law. Verification records are retained for the minimum period required under FINTRAC regulations. Access to this information is restricted to authorised personnel and is not shared with third parties except where required by law or regulatory obligation.
Individuals have the right to request information about how their personal data is handled. Requests of this nature should be directed to the designated privacy contact.
9. Refusal and Consequences
Stoney Nakoda Resort & Casino may refuse or suspend any transaction, account access, or service where:
- A person declines to provide required identity documentation
- The documents provided cannot be verified or are found to be invalid
- There is reasonable suspicion of fraud, misrepresentation, or money laundering
- The individual does not meet the minimum age requirement
Refusal of service on these grounds does not constitute a breach of obligation by the company. It reflects compliance with Canadian law.
